It comes as the Nationality and Borders Bill comes under renewed scrutiny from MPs.
Just three Conservative MPs voted against the offshoring plan, while Edward Leigh urged the government to "hold the line".
The case is putting pressure on the Home Office to provide answers after labelling those convicted of the offence as “people smugglers” and claiming small boat crossings were illegal.
Officials have also criticised UK plans to push back boats and allow British patrols on their beaches.
